There are regular employment and non-regular employment in Japan.

The below is a summary of employment terms & condition

Regular Employment
(Full-time Employee/ Permanent Employee)

Their employment contract does not stipulate a fixed period. Typically work for prescribed working hours specified in the Rules of Employment. The company expects a full-time employee to work comprehensively, to accumulate skills and to contribute to the company over the long term

Non-regular Employment
(Part Timer, Contract Employee)

  • Contract employee – Typically work for specialized work with a fixed term

  • Part timer – Normally conduct ancillary work. Typically seen housewives/students who work specific tasks with shorter working hours 

  • Temporary staff –Normally hired by the manpower agency and dispatched to the company to work.

Labor and Social Insurance

Workers' Accident Compensation Insurance

  • Workers' Accident Compensation Insurance covers illness or injury at work or while commuting to or from work

  • Applicable to all workers but not applicable to directors and representative of the company

  • Notifications shall be submitted to the local Labor Standards Inspection Office 

  • Premiums are fully beared by the employer. The rates are from 0.25% to 8.8% depending on the business of the company

Employment Insurance

  • Employment Insurance provides unemployed workers temporary financial aid and subsidies.

  • Applicable to workers whose prescribed working hours are not be less than 20 hours per week, and whose empolyment contract period is not less than 31 days

  • Notifications shall be submitted to the local Public Employment Security Office 

  • Premiums are beared by both employer and worker. The rates is 1.35% (employer 0.85% and worker 0.5%)

Health Insurance and Nursing Care Insurance

  • Health Insurance covers medical and nursing care expenses incurred by workers.

  • Applicable to all workers including directors and representative of the company. Part-time employees whose prescribed working hours are not less than 75% of those of full-time employees are applicable. Foreigners dispatched from certin countries such as the United States to Japan who are enrolled in medical insurance in these countries have an exemption. Nursing care insurance is only applicable to those who are 40 years or over.

  • Notifications shall be submitted to the local Pension Office or Health Insurance Union Office 

  • Premiums are beared by both employer and worker equally. The rates deffers depending on the registered location

Employees' Pension Insurance

  • Employees' Pension Insurance provides benefits for old age, death or disability.

  • Applicable to all workers including directors and representative of the company. Part-time employees whose prescribed working hours are not less than 75% of those of full-time employees are applicable. 

  • Notifications shall be submitted to the local Pension Office 

  • Premiums are beared by both employer and worker equally. The rate is 18.3%of the insured party's standard monthly remuneration (maximum: 650,000 JPY) and standard bonus (maximum: 1.5 million JPY)

Visa

Procedure for Certificate of Eligibility & Visa Acquisition

  1. Apply Certificate of Eligibility to Regional Immigration Bureau in Japan by the applicant or his/her proxy on behalf of the applicant

  2. Certificate of Eligibility is issued

  3. Apply Visa with Certificate of Eligibility at Japanese embassy abroad

  4. Enter into Japan, present a passport with visa and Certificate of Eligibility, receive a seal of landing verification in passport at the immigration in airport, and receive a residence card

Procedure for Certificate of Eligibility & Visa Acquisition

Below are the main statuses of residence related to investment in Japan

  • Business Manager

  • Highly Skilled Professional

  • Engineer/Specialist in Humanities/ International Services

  • Intra-company Transferee

  • Legal/Accounting Services

  • Skilled Labor

  • Specified Skilled Worker

To obtain the status of residence for Business Manager, physical independent office is required in principle 

Procedure for Certificate of Eligibility & Visa Acquisition

Some cities/prefectures support business startup activities by foreign entrepreneurs to encourage their investment.

Foreign entrepreneur who wishes to obtain this visa is to submits a business preparation activity plan to the local government. When approved, a certificate of confirmation is issued by local government which will be submitted for the visa application. After entering into Japan, foreign entrepreneurs shall change his status of residence to “Business Manager” by fufilling the requrements
